Copy fault.
The original BMW archive photo on Mike Dunns site shows this.

Original BMW R12 Military Pannier Rack
There is a 2nd different variation which does not have this type of lever/clip.
Does anyone have an original relic that shows clearly this part, with the lever opened?
The attached image is the Polish copy, which I have re machined the lever base to match the original and sit parallel as the original to its rack arm top.
The 2nd image shows my Polish copy with the 1st stage of alteration to match the one original version.
Now if you have an eye for detail? tell me what is different from the Polish copy compared to the original
its sitting on top of?
Because this is what I cannot understand looking at the overhead illustration, overhead being the clue??
Answer the clips they are shown inside the end of the pannier U recess which takes the pannier frame.
As drawn it would be impossible to turn them out! Clearly a mistake by BMW in the illustration.
Added to this on Mike Dunns R12 archive there is another image that shows the pannier frame well above the top of the u recess, making it impossible
to turn the clip over and onto it. But they have bent the clip up to fit on it.
I think this is going over the top for most owners!

R12 Pannier Rack Pannier Clips
The main issue with these copy racks apart from the detail accuracy is the arms are too long, so the bags hang in at an angle.
Dietmar mentioned this.
